1. Scope of Agreement

For the purpose of these Terms & Conditions, "Sun Dream Services" includes Sun Dream Services and Comfort Homes, as well as their owners, employees, contractors, affiliates, and representatives.

This rental agreement becomes binding upon confirmation of the reservation and receipt of payment.

The booking guest acts on behalf of all members of the party and is responsible for ensuring that all guests comply with these Terms & Conditions.

This agreement applies exclusively to the rental of the property and does not include any third-party services such as flights, travel insurance, or transportation.

The property is located in a residential area. Minor issues, normal wear and tear, or temporary malfunction of equipment do not constitute grounds for refunds or compensation.

Any additional agreements must be confirmed in writing.

2. Reservation & Payment

  • A 30% deposit is due at the time of booking
  • The remaining balance is due 30 days prior to arrival

Accepted payment methods:

  • Bank transfer (preferred)
  • Check
  • Zelle / Venmo
  • PayPal
  • Credit card (+5% processing fee)

Failure to complete payment may result in cancellation of the reservation without refund.

By completing payment, the guest agrees to these Terms & Conditions and waives the right to dispute charges that are in accordance with this agreement.

3. Damage Waiver

A non-refundable damage waiver fee of $30 is charged per booking.

This covers accidental damages up to $500 during the stay.

The damage waiver does NOT cover:

  • Intentional damage
  • Gross negligence
  • Misuse of the property

Any damage exceeding $500 will be charged to the guest.

4. Security Authorization (Credit Card on File)

A valid credit card must be provided prior to arrival.

No security deposit will be held or blocked on the card.

The card is kept on file for security purposes only.

The guest authorizes Sun Dream Services to charge the credit card in case of:

  • Damages exceeding the damage waiver coverage
  • Missing items (e.g., keys, garage remotes)
  • Additional cleaning due to misuse
  • Violations of these Terms & Conditions

Charges may be applied after departure once the property has been inspected.

Any charges will be documented and communicated to the guest.

The guest authorizes such charges without requiring additional approval.

5. Cancellation Policy

  • More than 30 days before arrival:
    A cancellation fee of 30% of the total booking amount applies
  • 30 days or less before arrival:
    A 100% cancellation fee applies

All cancellations must be submitted in writing.

Rebooking / Replacement Guest

If Sun Dream Services is able to rebook the property for the same period, a refund may be issued on a case-by-case basis.

Rebooking is not guaranteed and depends on availability and market conditions.

Travel Insurance

Travel insurance is strongly recommended, especially for international guests traveling from outside the United States or Canada.

6. Arrival & Departure

  • Check-in: 4:00 PM
  • Check-out: 10:00 AM

Early check-in or late check-out may be granted upon request and availability.

7. Use of Property

  • Only the number of guests stated in the reservation is permitted
  • Changes to the number of guests must be approved in advance
  • Maximum occupancy must not be exceeded
  • No parties, events, or unauthorized gatherings

Violation may result in immediate termination of the stay without refund.

8. Guest Responsibilities

Guests agree to:

  • Treat the property and its contents with care
  • Report damages immediately
  • Maintain reasonable cleanliness
  • Secure the property when leaving

Lost or unreturned items such as keys, garage door openers, or access devices will result in replacement charges.

Replacement costs may include reprogramming or security adjustments if necessary.

The property must be left in a reasonable condition. Excessive cleaning or misuse may result in additional charges.

Sun Dream Services is not responsible for items left behind. Retrieval and shipping may be subject to handling fees.

9. Pool, Waterfront & Equipment - Liability

Use of the property and all amenities, including but not limited to:

  • Pool
  • Dock / waterfront
  • Bicycles
  • Kayaks
  • Any provided equipment

is entirely at the guest's own risk.

Guests are responsible for safe and proper use of all amenities.

Children must be supervised at all times, especially in pool and waterfront areas.

Guests agree to release and hold harmless Sun Dream Services from any claims, injuries, damages, or losses arising from use of the property or its amenities, except in cases of gross negligence or willful misconduct.

This includes but is not limited to accidents, injuries, or loss occurring on the premises.

10. Access

Sun Dream Services reserves the right to access the property at any time in case of emergency.

Guests agree to allow access for scheduled pool and lawn maintenance services.

11. Electricity & Utilities

Electricity, water, internet, and standard utilities are included in the rental price unless otherwise specified.

Guests agree to use air conditioning responsibly.

Leaving doors or windows open while AC is running or setting extremely low temperatures may result in additional charges.

No guarantees are made regarding uninterrupted services or amenities.

12. Smart TV, Internet & Media Services

The property is equipped with Smart TVs or cable TV, depending on the home, providing access to a variety of channels and applications.

Subscription-based services (e.g., sports packages, live events, premium channels) are not included.

Guests may log into their own accounts at their own discretion.

Guests are responsible for logging out of their personal accounts before departure.

Sun Dream Services is not liable for any misuse, unauthorized access, or charges resulting from accounts left logged in.

Internet and WiFi are provided as a convenience only.

Service interruptions, speed issues, or regional restrictions do not entitle guests to refunds.

Sun Dream Services is not responsible for:

  • Content availability
  • Regional restrictions
  • Service interruptions

13. Security Cameras

For security reasons, exterior cameras may be installed (e.g., entrance or driveway areas).

Cameras are used solely for security purposes.

  • Cameras are strictly limited to outdoor areas
  • No cameras monitor interior or private areas such as the pool

Neighboring properties may also use security cameras.

By booking the property, guests acknowledge and accept the presence of such external security measures.

14. Cleaning Standard

The property is professionally cleaned before arrival; however, it is a private home and not a hotel.

Minor imperfections do not constitute grounds for refunds.

15. Pest & Environment Disclaimer

Due to the tropical climate in Florida, insects or wildlife may occasionally be present despite regular pest control.

This does not constitute a defect or grounds for refund.

16. Pool Heater Disclaimer

Pool heating is provided as a convenience and may be affected by weather conditions.

Desired temperatures cannot be guaranteed and do not constitute grounds for refunds.

17. Third-Party Services

Sun Dream Services may use third-party vendors for certain services.

Delays or issues beyond our control do not entitle guests to compensation.

18. Documentation & Evidence

Sun Dream Services reserves the right to document the condition of the property before, during, and after the stay.

Such documentation may be used in case of disputes or damage claims.

19. Availability & Force Majeure

If the property becomes unavailable due to unforeseen circumstances:

  • A comparable alternative will be offered, or
  • A full refund will be issued

No additional compensation will be provided.

20. Construction & External Factors

Cape Coral is a growing area.

Construction, noise, neighbor activity, or environmental factors do not qualify for refunds or discounts.

21. No Refund for Early Departure

No refunds will be issued for:

  • Early departure
  • Weather conditions
  • Hurricanes or natural events
  • Personal reasons

22. Liability Disclaimer

Sun Dream Services is not responsible for:

  • Loss or damage of personal belongings
  • Injuries or accidents
  • Interruptions beyond their control

Guests use the property at their own risk.

23. Indemnification

Guests agree to indemnify and hold harmless Sun Dream Services from any claims, damages, liabilities, or expenses arising from:

  • Violation of these Terms
  • Improper use of the property
  • Actions of any member of the guest's party

24. Additional Legal Provisions

No Subletting

The reservation may not be transferred, subleased, or assigned without written approval.

Identity Verification

Sun Dream Services reserves the right to request identification and verification of the booking party.

Right to Refuse Service

Sun Dream Services reserves the right to refuse or cancel any booking prior to arrival.

House Rules

Guests agree to comply with all house rules provided prior to arrival or displayed at the property.

Smoking

Smoking is strictly prohibited inside the property. Additional cleaning or damage fees may apply.

Pets

Pets are only allowed if explicitly approved in advance and may be subject to additional fees.

Illegal Activities

Any illegal activity is strictly prohibited and will result in immediate termination without refund.

25. Communication

All important communication must be made in writing (e.g., email, text message, WhatsApp, including automated messages).

Verbal agreements are not binding unless confirmed in writing.

26. Chargeback Protection

The guest agrees not to initiate chargebacks or payment disputes for services provided in accordance with this agreement.

Any disputes must be addressed directly with Sun Dream Services.

27. Noise & Local Regulations

Guests must comply with local noise regulations and respect quiet hours.

28. Minimum Stay Requirements

Minimum stay requirements may apply in accordance with local regulations.

29. Governing Law

This agreement is governed by the laws of the State of Florida.

Jurisdiction: Lee County, Florida.

30. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
